DUI
DUI is a charge relating to the consumption of alcohol that is applicable only to minors. Driving under the influence is a charge given to a minor who is stopped while driving and is found to have consumed any detectable amount of alcohol. The key here is that the minor doesn’t have to be over the legal limit to be charged. This charge is part of Texas’ Zero Tolerance position relating to all things concerning minors and alcohol. The days of an officer merely calling a person's parents are over.
If you are a minor and had something to drink with your parents’ permission and then are stopped driving, admitting to consuming any alcohol at all gives the police officer all the proof he needs to charge you with a DUI. A DUI is a Class C Misdemeanor.
The fines for a DUI are not to exceed $500. If you have already received two DUI convictions, the penalties for the third increase exponentially. The fine for a third DUI is no less than $500 and not more than $2000. In addition, an individual can receive a jail sentence of up to 6 months.
The Department of Public Safety will suspend the minor’s license, as an additional punishment to the fines and jail time. If it is a first offense, the suspension is 6 months. The second offense carries a 4 month suspension. The third offense goes back to 6 months.
