Dallas MIC Lawyer

A minor in consumption (MIC) is a citation given out by either a police officer or an officer of the Texas Alcoholic Beverage Commission (TABC). Here, a minor, someone who is under the age of 21, is caught consuming an alcoholic beverage.

Unlike an MIP, possession is not enough. The officer must prove that the minor has actually consumed the beverage. This crime does not apply if an individual is within visible presence of and have the consent of their adult parent, legal guardian, or spouse.

If an individual has a previous MIC conviction, he or she is not eligible for deferred disposition. Deferred disposition is a way of having a citation dismissed after completing a probationary period during which no additional convictions are received and after all requirements imposed in the deferred order (alcohol awareness classes, community service, etc.) have been completed in a satisfactory manner. The probationary period can be between 90 and 180 days. If any elements of both probation and the deferred order are violated, a final judgment of guilty will be entered into the record on the 120th day without further notice.

An MIC is a Class C Misdemeanor. It carries with it a fine of between $250 and $2000 and or up to 180 days in jail. Also community service related to alcohol misuse and or prevention from 8 to 40 hours can be assigned. In addition, it is possible for a judge to suspend an individual's license for between 30 and 180 days.
